Terms of Sale

1. General provisions
1.1 These terms of sale apply to all purchases made from the online store www.curatedbynoar.eu.
1.2 The seller is NOARhouse OÜ (registry code 17323262, registered address Uus tn 22, 10111 Tallinn, Estonia; boutique Suur-Karja 2, 10140 Tallinn, Estonia; email hello@curatedbynoar.eu, phone +372 5354 9954), trading as Curated by NOAR ("NOAR"). NOARhouse OÜ is not VAT registered.
1.3 By placing an order, you confirm that you have read and accept these terms of sale and the privacy policy.
1.4 NOAR may update these terms of sale. Your order is governed by the terms in force at the time the order was placed.
2. Products and authenticity
2.1 NOAR sells pre-owned luxury women's clothing, shoes, bags and accessories. Some pieces are sold on consignment. NOARhouse OÜ sells consignment pieces in its own name as well and is the buyer's contracting party.
2.2 Every piece is one of a kind and remains available until sold. Adding a piece to your basket does not reserve it.
2.3 NOAR describes each piece's condition, measurements and signs of wear on the product page. Colours may vary slightly depending on your screen.
2.4 NOAR inspects every piece for authenticity before sale and uses an independent authentication service where needed. Any original accessories or authentication documents included with a piece are stated on the product page and supplied with the order.
2.5 Curated by NOAR is not affiliated with any of the fashion houses whose pieces it sells. All trademarks belong to their respective owners.
3. Prices
3.1 All prices in the online store are in euros (EUR).
3.2 NOARhouse OÜ is not registered for VAT, so no VAT is added to the prices.
3.3 Shipping costs are added to the price of the item and displayed in the basket before you confirm your order.
3.4 For deliveries outside the European Union, the buyer is responsible for all customs duties, import taxes and carrier customs clearance fees in the destination country.
3.5 In the event of an obvious pricing error, NOAR will contact you. You may then cancel the order and receive a full refund.
4. Ordering and conclusion of the contract
4.1 You can complete your purchase as a guest without creating a customer account.
4.2 To place an order, add the piece to your basket, enter your contact and delivery details, select a delivery and payment method, and confirm the order.
4.3 The sales contract is concluded once payment has been received in NOARhouse OÜ's bank account and NOAR has sent an order confirmation to your email address.
4.4 If, due to a technical error, the same one-of-a-kind piece is sold to more than one buyer, the piece goes to the buyer whose payment was received first. NOAR will refund the other buyer in full without delay.
5. Payment
5.1 Accepted payment methods in the online store are Estonian, Latvian, Lithuanian and Finnish bank links, payment cards (Visa, Mastercard), Apple Pay and Google Pay.
5.2 Online payments are processed by Montonio Finance OÜ (and in-store payments at the boutique by SumUp). Payment takes place in a secure payment environment outside the online store. NOAR does not see or store your bank or card details. NOARhouse OÜ is the controller of personal data and transfers the personal data necessary for processing payments to its processor, Montonio Finance OÜ.
5.3 Orders must be paid for in full when placed.
6. Shipping and delivery
6.1 Every piece is packed in our Tallinn boutique and handed over to the carrier within 1–2 working days of receiving payment. Parcels are delivered by Omniva (AS Eesti Post). Once your parcel is dispatched, we email you a tracking link.
6.2 Delivery options, prices and estimated delivery times:
- Estonia parcel locker (Omniva): €3.90, free on orders over €250 (1–2 working days);
- collection from the boutique (Suur-Karja 2, 10140 Tallinn): free (during boutique opening hours Tue–Fri 12:00–18:00 and Sat 12:00–16:00);
- Latvia and Lithuania parcel locker (Omniva): €7.90 (2–4 working days);
- Finland parcel locker (Omniva): €9.90 (2–5 working days);
- Sweden parcel locker or pickup point (Omniva): €14.90 (3–6 working days);
- other countries: insured and tracked shipment via Omniva by individual quote (email hello@curatedbynoar.eu).
6.3 Orders are delivered within 30 days of the conclusion of the contract at the latest. If delivery within this period is not possible, NOAR will inform you and you will have the right to withdraw from the contract and receive a full refund.
6.4 The risk of accidental loss of or damage to the goods passes to the buyer when the buyer, or a third party named by the buyer other than the carrier, takes physical possession of the goods.
7. Right of withdrawal and returns
7.1 Under the Estonian Law of Obligations Act, consumers have the right to withdraw from an online purchase contract within 14 days without giving any reason. The 14-day period starts on the day you, or a person named by you other than the carrier, take physical possession of the goods.
7.2 To exercise the right of withdrawal, send an unequivocal notice to hello@curatedbynoar.eu or curatedbynoar@gmail.com no later than on the 14th day, stating your name, order number, the item being returned and the date of receipt.
7.3 Return the item to NOARhouse OÜ (Curated by NOAR boutique, Suur-Karja 2, 10140 Tallinn, Estonia, phone +372 5354 9954) without undue delay and no later than 14 days after sending your withdrawal notice.
7.4 The buyer bears the direct cost of returning the goods, unless the item does not conform to the contract. As every piece is unique and valuable, NOAR recommends using a tracked and insured delivery service. The sender remains responsible for the item until it reaches NOAR.
7.5 The returned item must be in the same condition as received: unworn, clean, undamaged, free of odours, and complete with all tags, labels and original accessories (dust bag, box, authenticity card and documents). If the item has been handled beyond what is necessary to establish its nature, characteristics and functioning, the buyer is liable for any resulting loss in value.
7.6 NOAR will refund all payments received from the buyer, including the standard initial delivery cost, without undue delay and no later than 14 days from receiving the withdrawal notice, using the same payment method the buyer used. NOAR may withhold the refund until it has received the goods back or the buyer has supplied proof of having sent back the goods.
7.7 The 14-day right of withdrawal does not apply to purchases made by legal persons or businesses acting in the course of their trade or profession.

8. Claims
8.1 Under the Estonian Law of Obligations Act, NOAR is liable for any lack of conformity of the goods that existed at the time of delivery and becomes apparent within two years of delivery to a consumer.
8.2 Because NOAR sells pre-owned pieces, most items show normal signs of prior use. Signs of wear that are described on the product page and visible in the product photos do not constitute a defect.
8.3 The buyer must notify NOAR of a defect within a reasonable time, and no later than within two months of discovering it, by emailing hello@curatedbynoar.eu or curatedbynoar@gmail.com with the order number, a description of the defect and photos. NOAR replies to claims within 15 days.
8.4 If a claim is justified, the buyer may request repair of the item, a price reduction, or withdrawal from the contract and a full refund. Because each piece is one of a kind, replacement is generally not possible. For justified claims, NOAR covers the return shipping cost.
9. Limitation of liability
9.1 NOAR is not liable for delays or damage caused by circumstances beyond its reasonable control, such as force majeure or carrier delays. This does not limit consumers' statutory rights.
10. Governing law and dispute resolution
10.1 NOAR aims to resolve any disagreement amicably. Please contact hello@curatedbynoar.eu or curatedbynoar@gmail.com.
10.2 If no agreement is reached, a consumer may submit the dispute to the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority (Endla 10a, 10142 Tallinn, www.ttja.ee, komisjon.ee) or to a court.
10.3 The contract is governed by Estonian law, without depriving consumers of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.
